Affiliate Program Terms

1. Who these terms bind

These Affiliate Program Terms are a contract between you and TOVELU — TOVELU is operated by Ajay Sen, an individual trading as “TOVELU” as a sole proprietorship established under the laws of India, at Indore, Madhya Pradesh, India. They apply from the moment you submit an application, and they incorporate our Terms of Service, Acceptable Use Policy, Privacy Policy and Earnings Disclaimer. You must be 18 or older and legally able to contract.

2. The two roles

• Affiliate — you promote TOVELU to your own audience and earn commission on the sales you generate.
• Affiliate Manager — you do not promote TOVELU to consumers. You recruit creators into the Affiliate program and support them, and you earn an override on the sales they make.

They are separate roles with separate applications. Holding one does not entitle you to the other, and you may not earn twice on the same sale.

3. Applying and being accepted

Applications are reviewed manually and acceptance is at our sole discretion. We may decline without giving reasons, and intake may be capped or closed at any time. Nothing on our marketing pages is an offer capable of acceptance; the program begins only when we confirm your account is active.

You must apply in your own name with accurate information, and keep it accurate — especially your payout address. One person or entity may hold one account of each type. You may not apply again under a different identity after being declined or terminated.

4. You are an independent contractor

You are an independent contractor, not an employee, agent, partner, joint venturer or representative of TOVELU. You have no authority to bind TOVELU, to make commitments on its behalf, to speak for it, to accept anything from a customer, or to describe yourself as working for it. You control your own methods, hours and costs, and you are responsible for your own expenses, insurance and taxes. Nothing here creates an exclusive relationship in either direction — you may promote other products, and we may work with anyone.

5. Commission — Affiliate

• 40% of the customer's first payment for TOVELU, on a qualifying sale you referred. At current prices that is US$107.20 on an annual sale (US$268/year) or US$11.20 on a monthly sale (US$28/month).
• First payment only. Commission is not earned on that customer's next renewal — monthly or annual — or on any subsequent payment. This is stated plainly so it is never a surprise.
• Commission is calculated on the amount actually received, after any discount applied, and after any tax included in the price.
• A sale qualifies only if it is a genuine purchase by a genuine new customer, properly attributed under Section 8, that is not refunded, charged back or reversed within the clearing period.

6. Commission — Affiliate Manager

• 10% override on every qualifying sale made by an Affiliate you recruited, for as long as they keep selling, with no cap on team size. At current prices that is US$26.80 on an annual team sale or US$2.80 on a monthly one.
• US$50 one-time joining bonus, credited when your application is approved.
• Two levels only. You earn on sales by the Affiliates you recruited. You do not earn on people they later recruit. There is no third level and there will not be one.
• Recruiting targets: 10 qualified Affiliates within your first 7 days, then a minimum of 20 qualified Affiliates each month. An Affiliate counts as qualified only once they have joined through your recruiting link and published their first promotional post, reel or story within 48 hours of joining. Targets are reviewed against your dashboard, and we will always speak with you before taking any action on them.
• Missing a target may result in suspension or termination of your Affiliate Manager account under Section 17. It never forfeits commission you have already earned on real sales.

7. What you are never paid for

To be unambiguous about the structure of this program:

• There is no fee to join, no pack to buy, no product to purchase and no quota to stock. Ever. If anyone asks you to pay to participate, it is not us.
• You are never paid for recruiting anyone. The Affiliate Manager override is paid on sales your recruits make to real customers. Recruiting a hundred people who never sell anything pays exactly nothing.
• Compensation flows only from genuine retail sales of TOVELU to genuine end customers.
• The structure stops at two levels.

8. Tracking and attribution

Referrals are tracked by Post Affiliate Pro using a cookie set when someone follows your link, and mirrored across our website and app domains so it survives the move to checkout. Attribution is last-click, within the cookie's lifetime, and is credited to the referral recorded at the time the sale is reported by our payment system.

You accept the practical limits of cookie tracking: a customer who blocks cookies, declines cookie consent, clears them, switches device or browser, or takes longer than the cookie's lifetime may not be attributed to you. We cannot pay commission on a sale that was not tracked. Our tracking records are the final determination of what is owed, absent manifest error. If you believe a sale was mis-tracked, tell us within 60 days and we will investigate in good faith.

9. Clearing, payouts and minimums

• 35-day clearing period. Commission is held for 35 days after the sale, then becomes payable. This exists because TOVELU carries a money-back guarantee of up to 30 days (see the Refund Policy); paying earlier would mean clawing money back from you afterwards. Pending and cleared balances are shown separately in your dashboard.
• Paid every Wednesday to the PayPal address on your account, with no request needed.
• US$100 minimum. A cleared balance below that rolls to the following Wednesday.
• Payouts are in US dollars. PayPal fees, currency conversion and any bank charges are yours.
• If your payout details are wrong or your PayPal account cannot receive the payment, we will hold the balance and tell you. Balances unclaimed for 12 months after we have made reasonable attempts to reach you may be forfeited, except where the law of your jurisdiction says otherwise.

10. Reversals and clawbacks

Commission is reversed if the underlying sale is refunded, charged back, cancelled within the guarantee window, reversed for fraud, or found to have breached these terms. If the reversal happens during the clearing period, the pending commission simply does not clear. If it happens afterwards, we may deduct it from future commissions or, where there are none, invoice you for it. We will always show you what was reversed and why.

11. Tax

You are solely responsible for all taxes on your commissions, including income tax, self-employment tax, VAT, GST and any local equivalent, and for your own registration, invoicing and reporting. TOVELU does not withhold tax unless legally required to; where it is required, we will withhold and remit and tell you. We may ask you for tax documentation appropriate to your country (for example a W-9, a W-8BEN, a GST or VAT number) and may suspend payouts until you provide it. Commissions are quoted exclusive of any tax you must charge us.

12. Mandatory disclosure of your relationship with us

Every time you promote TOVELU, you must disclose clearly and conspicuously that you are paid to do so. This is not optional and it is not a formality — it is the law in most of the places you will be posting.

• The disclosure must be in the post itself, not only in a bio, a link page, a comment or behind a “more” link. In a video, say it out loud and show it on screen, early. In a story, put it on the frame. In text, put it at the start.
• Use plain words: “paid partnership”, “#ad”, “I earn a commission if you buy through my link”. “#sp”, “#collab”, “thanks TOVELU” and an ambiguous “partner” are not enough.
• Use the platform's own paid-partnership tool as well as, not instead of, your own disclosure.
• This reflects the US FTC's Endorsement Guides (16 CFR Part 255), the UK CAP Code and CMA guidance, the ACCC's rules in Australia, ASCI's guidelines in India, and equivalent rules elsewhere. Follow whichever is strictest for your audience.
• Only endorse what you have actually experienced. Do not write a testimonial about a plan you never used, do not invent results, and do not use before-and-after images that are not yours or that were not produced using TOVELU.

We may ask you to correct or remove a non-compliant post, and you must do so within 48 hours.

13. Claims you must never make

TOVELU is a health product, which means a careless claim is a regulatory problem and a real harm to a real person. You must not, in any medium, state or imply that TOVELU:

• treats, cures, prevents, reverses or manages any disease or condition — including diabetes, PCOS, heart disease, cancer, epilepsy, thyroid disease, infertility or depression;
• is medical advice, is medically supervised, is doctor-approved, is clinically proven, or replaces a doctor or dietitian;
• will produce a specific weight loss, a specific rate of loss, or results in a specific time (“lose 10 kg in a month” and anything like it);
• works without effort, works for everyone, or is guaranteed to work;
• is safe during pregnancy or breastfeeding, or suitable for children, or suitable for someone with Type 1 diabetes or an eating disorder;
• is endorsed by, affiliated with or approved by any doctor, hospital, university, government body, regulator or brand, unless we have told you in writing that it is.

You must also not use fear, body shaming, weight stigma, or before-and-after imagery presented as typical; not target minors or anyone the product is not for; not promote it in eating-disorder communities or spaces; and not use AI-generated people, voices or “doctors” to endorse it. If you are unsure whether a claim is acceptable, ask us at affiliate@tovelu.store before you post — we answer quickly and we would much rather answer than enforce.

Income claims to prospective recruits are governed by the same principle and by our Earnings Disclaimer: never promise, guarantee or imply earnings, and always present the calculator on our site as arithmetic rather than a forecast.

14. Prohibited promotional methods

You must not:

• send unsolicited email or messages of any kind. All email promotion must be to a list that gave you consent, must identify you, and must carry a working unsubscribe — as required by CAN-SPAM, CASL, the GDPR/ePrivacy rules and their equivalents. Unsolicited SMS or automated calls are prohibited outright.
• bid on “TOVELU”, misspellings of it, or our domain names in paid search or app-store advertising, or use them in ad copy, display URLs or as a keyword; nor run paid search that lands directly on tovelu.store.
• register domains, subdomains, app names, social handles or pages containing “TOVELU” or a confusable variant;
• impersonate TOVELU, its founder, its support channels, or any employee — including creating “official” accounts, groups or support inboxes;
• engage in cookie stuffing, forced clicks, hidden iframes, pop-unders, adware, toolbars, browser extensions that inject links, or any method that sets a referral without a real click;
• use self-referral — buying through your own link, or arranging for family, alternate accounts or paid strangers to do so — or offering unauthorised cash-back, rebates or incentives for purchases;
• advertise unauthorised discounts, coupons or “free access”, or list TOVELU on coupon or deal sites without our written permission;
• place TOVELU alongside adult, hateful, violent, illegal, pirated or harassing content, or on sites that infringe intellectual property;
• use bots, click farms, fake followers or engagement pods to manufacture the appearance of reach;
• collect personal data from prospective customers on TOVELU's behalf, or run a lead-capture page that looks like ours.

15. Use of our name and brand

We grant you a limited, non-exclusive, revocable, non-transferable licence to use the TOVELU name, logo and marketing assets we supply, solely to promote TOVELU under these terms, for as long as you are an active participant. You may not alter the logo, use it as your own avatar or brand, register it, or use it in a way that suggests you are TOVELU. All goodwill from that use belongs to TOVELU. On termination the licence ends and you must remove our marks and your links within 7 days. Anything you create to promote TOVELU remains yours, but you grant us a non-exclusive licence to repost or quote it with attribution.

16. Customer data and privacy

You will never receive TOVELU customers' personal data. Your dashboard shows aggregate counts of clicks, sign-ups and sales, and the commission owed — never names, emails, health information or order contents. If you collect personal data from your own audience (an email list, a lead form), you are the controller of that data and are responsible for your own privacy notice, lawful basis, consent records and compliance with the GDPR, the DPDP Act, CASL, CAN-SPAM, state privacy laws and any other law that applies to you. You must not represent that TOVELU is responsible for it.

17. Term, termination and forfeiture

Either of us may terminate at any time, for any reason, on written notice (email is fine). We may suspend an account immediately while we investigate a suspected breach.

On ordinary termination — including by us, and including for missing a recruiting target — you are still paid every commission properly earned on genuine sales before termination, once it clears. We do not use termination as a way to avoid paying you.

Commission is forfeited only where a sale was fraudulent, self-referred, generated by a prohibited method in Section 14, or obtained through claims prohibited by Section 13. In those cases we may reverse related commissions, close the account, and recover amounts already paid. Serious or repeated breaches may also be reported to the relevant regulator or platform.

You may leave at any time by emailing us. Sections 10, 11, 15, 16, 19 and 20 survive termination.

18. Changes to the program

We may change commission rates, targets, clearing periods, payout mechanics or these terms. We will give at least 30 days' notice by email of any change that reduces your commission rate or increases your obligations, and the change will not apply to commissions already earned or to sales already made. Continuing to participate after the effective date is acceptance. We may also close, pause or discontinue either program entirely on 30 days' notice, paying out all cleared and pending balances that subsequently clear.

19. Disclaimers, liability and indemnity

The program is provided “as is”. We do not warrant that tracking will be uninterrupted or error-free, that any level of traffic, conversion or earnings will result, or that the program will continue indefinitely. We make no representation whatsoever about how much you will earn — see the Earnings Disclaimer.

To the fullest extent permitted by law, TOVELU's total liability to you in connection with the program is limited to the commissions properly earned and unpaid at the time of the claim, and we are not liable for indirect or consequential loss, lost profits or lost opportunity. This does not limit liability for fraud, for death or personal injury caused by negligence, or for anything that cannot lawfully be limited.

You will indemnify TOVELU against any claim, penalty, loss or cost (including reasonable legal fees) arising from your breach of these terms, your promotional content, any claim you made about TOVELU, your handling of anyone's personal data, or your tax position.

20. Governing law and disputes

These terms are governed by the laws of India, and Section 22 of our Terms of Service (informal resolution first; individual arbitration and class waiver for US participants, with a 30-day opt-out) applies to disputes under this program in the same way. Because you participate as a business rather than as a consumer, the consumer carve-outs in that section may not protect you.
